GO BRITAIN

TERMS AND CONDITIONS FOR THE SUPPLY OF GOODS

 

Go Britain must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received Go Britain will confirm that your order has been accepted by sending an e-mail or fax to you at the e-mail address or fax number you provide in your order form. Go Britain’s acceptance of your order brings into existence a legally binding contract. Go Britain reserves the right to refuse your order for any reason.

 

In these terms and conditions:-

    "Go Britain" means Go Britain Limited (CN 02272346) whose registered office is at 2 Jardine House, The Harrovian Business Village, Bessborough Road, Harrow, Middlesex, HA1 3EX, and any connected organisation that actually supplies goods ordered by you and any successor to Go Britain's business;

    "goods" means the products set out in our website;

    "us" means Go Britain and you;

    "working day" means 10:00 to 16:00 Monday to Friday excluding United Kingdom statutory and public holidays; and

    "you" and "your" means the person ordering goods.

     

The prices payable for goods and delivery and the manner in which payment must be made by you are set out in the Go Britain website www.go-britain.com.

 

If for whatever reason Go Britain is unable to supply goods ordered by you, any sum debited by Go Britain from your credit card will be re-credited to your account and Go Britain will notify you by e-mail at the address given by you in your order form. The refund will be made as soon as possible and in any event within 60 days of your order. Go Britain will not be obliged to offer any additional compensation for any disappointment suffered.

 

    5.1 Delivery will be made as soon as possible after your order is accepted.

    5.2 Go Britain will deliver the goods to the address you give at the time you make your order.

    5.3 Subject to availability of the goods, Go Britain will (unless agreed otherwise) execute your order within 60 days. If Go Britain is unable to execute your order within 60 days, we will tell you, and you will have the option to cancel your order in writing under clause below.

    5.4 Once goods have been delivered to you they will be at your own risk and Go Britain will not be liable for their loss or destruction.

    5.5 You will be responsible for the cost of delivery

     

    6.1 You may withdraw your order for goods at any time up to the end of the seventh working day after receipt of the goods. You do not need to give Go Britain any reason for withdrawing your order nor will you have to pay any penalty during this period.

    6.2 The only circumstances in which you cannot withdraw your order are:-

      6.2.1 where you have taken the goods out of the sealed package in which they were delivered and/or used the goods, or

      6.2.2 where you have damaged the goods in any way.

    6.3 To withdraw your order you must notify Go Britain either by e-mail, fax, telephone or in writing and follow the returns procedure.

    6.4 If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their sealed package and/or used or damaged the goods, you must send them back to the Go Britain contact address at your own cost and risk. If you withdraw your order but Go Britain has already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to Go Britain at the Go Britain contact address at your own cost and risk as soon as possible.

    6.5 Once you have notified Go Britain that you are withdrawing your order, any sum debited to Go Britain from your credit card will be re-credited to your account as soon as possible and in any event within 60 days of your order PROVIDED THAT the goods in question are returned by you at your own cost and risk and received by Go Britain in the condition they were in when delivered to you.

    7.1 If the goods Go Britain delivers are not what you ordered, or if they are damaged, defective or the delivery is of an incorrect quantity or if you do not receive the goods within 60 days of the date on which you ordered them from Go Britain you may request Go Britain, advising Go Britain of your problem, in writing within 10 working days (or within 60 days of the date on which you ordered the goods if such goods were not received) to:-

      7.1.1 make good any shortage or non-delivery;

      7.1.2 replace or repair any goods that are damaged or defective; or

      7.1.3 refund to you the amount paid by you for the goods.

    In the case of 7.1.2 or 7.1.3 you should return the goods to Go Britain in accordance with clause 6.4.

    7.2 Go Britain will not be liable to you for any loss or damage whatsoever and howsoever arising including direct, indirect, consequential, income or profit, loss of data, loss of or damage to property and/or claims of third parties arising out of any problem you notify to Go Britain under this clause and Go Britain shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question. Nothing in this clause attempts to exclude or limit liability to you for death or personal injury caused by Go Britain’s negligence.

    7.3 Other than Go Britain’s liability under 7.1 above Go Britain shall not be liable to you for any failure to deliver goods you have ordered or for any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control. For the purposes of this clause 7.3, acts of God, civil commotion, riots, flood, drought, fire, shortages and adverse legislative changes are acts beyond the reasonable control of Go Britain.

    7.4 Nothing in this clause 7 seeks to exclude Go Britain's liability for death or personal injury incurred as a result of Go Britain's negligence.
    NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS AS A CONSUMER.

If any part of these conditions is unenforceable the enforceability of any other part of these conditions will not be affected.

 

These terms and conditions cannot be varied except in writing and signed by an authorised representative of Go Britain and you. These terms and conditions together with the current Go Britain Web site prices, delivery details and Go Britain contact details, set out the whole of our agreement relating to the supply of the goods to you by Go Britain. Nothing in these terms and conditions will exclude Go Britain's liability for fraud.

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have exclusive jurisdiction to resolve any disputes between us.
